This Privacy Policy describes Our policies and procedures on the collection, use and disclosure of Your information when You use the Service and tells You about Your privacy rights and how the law protects You.

We use Your Personal Data to provide and improve the Service. This Privacy Policy explains what We collect and why. Where the law requires Your consent, We ask for it separately and You may withdraw it at any time. Using the Service is not by itself treated as consent to the processing of health-related data.

Interpretation and Definitions

Interpretation

The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

For the purposes of this Privacy Policy:

Account means a unique account created for You to access our Service or parts of our Service.

Affiliate means an entity that controls, is controlled by or is under common control with a party, where "control" means ownership of 50% or more of the shares, equity interest or other securities entitled to vote for election of directors or other managing authority.

AI Provider means a third party that operates an artificial intelligence model which processes data on Our behalf in order to deliver a feature of the Service.

Body Analysis means the optional feature of the Service that estimates a body fat percentage range from a photograph of Your body and, at Your request, generates an illustrative visualisation image.

Company (referred to as either "the Company", "We", "Us" or "Our" in this Agreement) refers to FUTURESOFT Mazurek i Niedziela Spółka Komandytowa, Aleja "Solidarności" 117/207, 00-140 Warsaw, Poland. Registered in the Polish National Court Register (KRS) under number 0001182115, with EU VAT ID (NIP) PL5253053408.

Cookies are small files that are placed on Your computer, mobile device or any other device by a website, containing the details of Your browsing history on that website among its many uses.

Country refers to: Poland

Device means any device that can access the Service such as a computer, a cellphone or a digital tablet.

Personal Data is any information that relates to an identified or identifiable individual.

Service refers to the mobile application and website accessible at slimai.app.

Service Provider means any natural or legal person who processes the data on behalf of the Company. It refers to third-party companies or individuals employed by the Company to facilitate the Service, to provide the Service on behalf of the Company, to perform services related to the Service or to assist the Company in analyzing how the Service is used.

Usage Data refers to data collected automatically, either generated by the use of the Service or from the Service infrastructure itself (for example, the duration of a page visit).

You means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

Collecting and Using Your Personal Data

Types of Data Collected

Personal Data

While using Our Service, We may ask You to provide Us with certain personally identifiable information that can be used to contact or identify You. Personally identifiable information may include, but is not limited to:

  • Email address
  • First name and last name
  • Health-related information (for example: meals, hydration, physical activity, fasting data, height, weight, age, sex and dietary goals)
  • Photographs of meals and of food items, submitted to the AI Food Scanner and the AI Fridge features
  • Photographs of Your body and body analysis data, submitted to the optional Body Analysis feature, together with the results derived from them (an estimated body fat percentage range and, where You request one, an AI-generated visualisation image)
  • Device data
  • Usage Data

Providing a photograph of Your body is always optional. The rest of the Service works without it.

Usage Data

Usage Data is collected automatically when using the Service.

Usage Data may include information such as Your Device's Internet Protocol address (e.g. IP address), browser type, browser version, the pages of our Service that You visit, the time and date of Your visit, the time spent on those pages, unique device identifiers and other diagnostic data.

When You access the Service by or through a mobile device, We may collect certain information automatically, including, but not limited to, the type of mobile device You use, Your mobile device unique ID, the IP address of Your mobile device, Your mobile operating system, the type of mobile Internet browser You use, unique device identifiers and other diagnostic data.

We may also collect information that Your browser sends whenever You visit our Service or when You access the Service by or through a mobile device.

Tracking Technologies and Cookies

We use Cookies and similar tracking technologies to track the activity on Our Service and store certain information. Tracking technologies used are beacons, tags, and scripts to collect and track information and to improve and analyze Our Service. The technologies We use may include:

  • Cookies or Browser Cookies. A cookie is a small file placed on Your Device. You can instruct Your browser to refuse all Cookies or to indicate when a Cookie is being sent. However, if You do not accept Cookies, You may not be able to use some parts of our Service. Unless you have adjusted Your browser setting so that it will refuse Cookies, our Service may use Cookies.
  • Web Beacons. Certain sections of our Service and our emails may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit the Company, for example, to count users who have visited those pages or opened an email and for other related website statistics (for example, recording the popularity of a certain section and verifying system and server integrity).

Cookies can be "Persistent" or "Session" Cookies. Persistent Cookies remain on Your personal computer or mobile device when You go offline, while Session Cookies are deleted as soon as You close Your web browser.

We use both Session and Persistent Cookies for the purposes set out below:

  • Necessary / Essential Cookies. Type: Session Cookies. Administered by: Us. Purpose: These Cookies are essential to provide You with services available through the Website and to enable You to use some of its features. They help to authenticate users and prevent fraudulent use of user accounts. Without these Cookies, the services that You have asked for cannot be provided, and We only use these Cookies to provide You with those services.
  • Cookies Policy / Notice Acceptance Cookies. Type: Persistent Cookies. Administered by: Us. Purpose: These Cookies identify if users have accepted the use of cookies on the Website.
  • Functionality Cookies. Type: Persistent Cookies. Administered by: Us. Purpose: These Cookies allow us to remember choices You make when You use the Website, such as remembering your login details or language preference. The purpose of these Cookies is to provide You with a more personal experience and to avoid You having to re-enter your preferences every time You use the Website.

Use of Your Personal Data

The Company may use Personal Data for the following purposes:

  • To provide and maintain our Service, including to monitor the usage of our Service.
  • To manage Your Account: to manage Your registration as a user of the Service. The Personal Data You provide can give You access to different functionalities of the Service that are available to You as a registered user.
  • For the performance of a contract: the development, compliance and undertaking of the contract for the products, items or services You have purchased or of any other contract with Us through the Service.
  • To contact You: To contact You by email, telephone calls, SMS, or other equivalent forms of electronic communication, such as a mobile application's push notifications regarding updates or informative communications related to the functionalities, products or contracted services, including security updates.
  • To provide You with news, special offers and general information about other goods, services and events which we offer that are similar to those that you have already purchased or enquired about unless You have opted not to receive such information. Where the law requires prior consent for marketing communications sent by electronic means, We send them only if You have given that consent, and You may withdraw it at any time.
  • To manage Your requests: To attend and manage Your requests to Us.
  • For business transfers: We may use Your information to evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Personal Data held by Us about our Service users is among the assets transferred.
  • For other purposes: We may use Your information for other purposes, such as data analysis, identifying usage trends, determining the effectiveness of our promotional campaigns and to evaluate and improve our Service, products, services, marketing and your experience.

We may share Your personal information in the following situations:

  • With Service Providers: We may share Your personal information with Service Providers to monitor and analyze the use of our Service, to contact You, and to deliver features of the Service as described in the section "Artificial Intelligence and Third-Party AI Providers" below.
  • For business transfers: We may share or transfer Your personal information in connection with, or during negotiations of, any merger, sale of Company assets, financing, or acquisition of all or a portion of Our business to another company.
  • With Affiliates: We may share Your information with Our affiliates, in which case we will require those affiliates to honor this Privacy Policy. Affiliates include Our parent company and any other subsidiaries, joint venture partners or other companies that We control or that are under common control with Us.
  • With business partners: We may share limited information with Our business partners to offer You certain products, services or promotions. We never share health-related information, photographs, body analysis results or AI-generated visualisations with business partners, advertising networks or data brokers, and we never use such data for advertising, marketing or use-based data mining.
  • With other users: when You share personal information or otherwise interact in the public areas with other users, such information may be viewed by all users and may be publicly distributed outside. Photographs, body analysis results and AI-generated visualisations are never made public by us. They are shared only if You actively choose to share them yourself using the sharing function of Your device.
  • With Your consent: We may disclose Your personal information for any other purpose with Your consent.

Photographs and AI Features

Three features of the Service work by processing a photograph You take or select:

  • AI Food Scanner. You photograph a meal and We return an estimate of its calories, macronutrients and Health Score.
  • AI Fridge. You photograph food items and We return recipe suggestions.
  • Body Analysis. You photograph Your body and We return an estimated body fat percentage range and, at Your request, an illustrative visualisation image. This feature is optional.

In each case the photograph is sent from the app to Our servers over an encrypted connection, and Our servers then send it to Our AI Provider for processing. Photographs are stored in private Google Cloud Storage buckets located in the European Union, with public access permanently blocked. Meal photographs and body photographs are held in separate buckets. Our application can only reach a stored image through a signed link that expires after five minutes.

We do not sell Your photographs, we do not share them with advertisers, advertising networks, data brokers or business partners, and we do not use them for marketing or use-based data mining.

Body Analysis (Photographs of Your Body)

The Body Analysis feature lets You take or select a photograph of Your body. We use it to produce two results: an estimated body fat percentage range, and an AI-generated visualisation showing how You could look after reaching Your goal.

Using this feature is entirely optional. You can skip it during onboarding and never use it, and every other part of the Service remains fully available to You.

What we do with Your photograph

The feature works in two separate steps, and You control the second one.

When You submit a photograph, it is transmitted over an encrypted connection to OpenAI, which acts as Our processor and estimates Your body fat range on Our behalf (model gpt-4.1). Nothing else happens at this stage.

A visualisation is generated only if You explicitly request one. Only then is Your photograph processed a second time, again by OpenAI, to create the image (model gpt-image-1). If You never request a visualisation, this second step never runs.

OpenAI processes Your photograph solely to return the result to Us. Under OpenAI's terms for the interface We use, data submitted through it is not used to train their models. We have also disabled every data-sharing option available in Our OpenAI organisation settings. OpenAI retains a short-lived working copy for abuse monitoring, currently for up to 30 days, after which it is deleted.

We do not use Your photograph to identify You

We do not perform facial recognition and we do not create, derive or store any biometric identifier or biometric template from Your photograph. We do not compute or retain face embeddings, face geometry, facial landmarks, gait data or any other template capable of identifying You. The analysis produces only an estimated body fat percentage range and a visualisation image, and nothing in the process is used to identify or authenticate any individual.

We do not train our own models on Your photographs

We do not use Your photographs or the resulting visualisations to train, fine-tune or improve any artificial intelligence model, whether Ours or a third party's.

This is an estimate, not a medical measurement

The estimated body fat percentage is a statistical estimate produced by an artificial intelligence model from a single two-dimensional photograph. It is not a clinical measurement, it is not equivalent to methods such as DEXA, hydrostatic weighing or bioelectrical impedance analysis, and it carries a margin of error that varies with lighting, clothing, camera angle and body type. The AI-generated visualisation is an illustrative aspirational image, not a prediction, forecast or promise of any result You will achieve. Neither output is medical advice, a diagnosis, or a substitute for consultation with a qualified healthcare professional.

Artificial Intelligence and Third-Party AI Providers

Several features of the Service rely on artificial intelligence models operated by a third party. We disclose below which data is sent to which provider:

Where You are located in the European Economic Area or Switzerland, Our contracting party and processor is OpenAI Ireland Limited, established in the European Union. OpenAI acts as a processor on Our behalf under OpenAI's Data Processing Addendum, which forms part of Our agreement with them. OpenAI may not use Your data for its own purposes and may not use it to train its models.

Body Analysis only runs when You actively choose to submit a photograph. By submitting a photograph, having been informed through this Privacy Policy of who processes it and for what purpose, You give Your explicit consent to the processing described in this section. You may withdraw that consent at any time, as described in the section "Delete Your Personal Data" below.

Legal Bases for Processing (GDPR)

Where the General Data Protection Regulation applies, we process Your Personal Data on the following legal bases:

  • Performance of a contract (Art. 6(1)(b) GDPR) — to provide the Service You subscribed to, manage Your account and process Your subscription.
  • Your explicit consent (Art. 6(1)(a) and Art. 9(2)(a) GDPR) — to process health-related data, including meals, physical activity, fasting data, photographs of Your body and body analysis results. Health data is a special category of personal data under Art. 9 GDPR and we process it only on the basis of Your explicit, separately given consent. You may withdraw that consent at any time.
  • Legitimate interests (Art. 6(1)(f) GDPR) — to secure the Service, prevent fraud and abuse, and analyse aggregated usage in order to improve the Service. We never rely on legitimate interests to process health data or photographs of Your body.
  • Legal obligation (Art. 6(1)(c) GDPR) — to comply with accounting, tax and consumer protection obligations.

Retention of Your Personal Data

The Company will retain Your Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use Your Personal Data to the extent necessary to comply with our legal obligations, resolve disputes, and enforce our legal agreements and policies.

For photographs we apply the following specific retention periods:

These photographs are also deleted earlier if You ask Us to delete them, as described in the section "Delete Your Personal Data" below. When a photograph is deleted we remove it without undue delay; our storage provider retains a backup copy which expires within 7 days.

The Company will also retain Usage Data for internal analysis purposes. Usage Data is generally retained for a shorter period of time, except when this data is used to strengthen the security or to improve the functionality of Our Service, or We are legally obligated to retain this data for longer time periods.

Transfer of Your Personal Data

Where our data is hosted. Our application servers and database are located in France, our processing queues in Germany, and photographs are stored in Google Cloud Storage in the European Union.

Transfers outside the European Economic Area. Two categories of data leave the European Economic Area:

  • Photographs sent to Our AI Provider. Where You are located in the European Economic Area or Switzerland, Our processor is OpenAI Ireland Limited, established in the European Union. Where OpenAI transfers that data to its affiliates outside the European Economic Area in order to provide the service, it does so on the basis of agreements containing the European Commission's Standard Contractual Clauses, or on the basis of an adequacy decision issued by the European Commission under Art. 45 GDPR.
  • Account data held in Firebase Authentication. Your account credentials are held in Google's infrastructure, which includes locations in the United States. Google acts as Our processor under its own data processing terms, which incorporate the European Commission's Standard Contractual Clauses.

We transfer only the data needed to deliver the relevant feature. The Company will take all steps reasonably necessary to ensure that Your data is treated securely and in accordance with this Privacy Policy.

Delete Your Personal Data

You have the right to delete or request that We assist in deleting the Personal Data that We have collected about You.

Our Service may give You the ability to delete certain information about You from within the Service.

You may update, amend, or delete Your information at any time by signing in to Your Account, if you have one, and visiting the account settings section.

You can also request deletion of any photograph, analysis result or visualisation, or withdraw Your consent to the Body Analysis feature, at any time by contacting Us at [email protected]. We action such requests without undue delay and in any case within one month. Withdrawing consent does not affect the lawfulness of processing carried out before the withdrawal, and it does not limit Your access to the rest of the Service.

Please note, however, that We may need to retain certain information when we have a legal obligation or lawful basis to do so.

Your Rights Under GDPR

If You are located in the European Economic Area, You have the right to access Your Personal Data, to have it rectified, to have it erased, to restrict or object to its processing, to receive it in a portable format, and to withdraw any consent You have given at any time. To exercise any of these rights, contact Us at [email protected]. We will respond within one month.

We do not make decisions based solely on automated processing that produce legal effects concerning You or similarly significantly affect You. The body fat estimate and the Health Score are informational outputs; they do not restrict Your access to the Service or to any benefit.

You also have the right to lodge a complaint with a supervisory authority. Our lead supervisory authority is the Polish Personal Data Protection Office (Prezes Urzędu Ochrony Danych Osobowych), ul. Stawki 2, 00-193 Warsaw, Poland.

Disclosure of Your Personal Data

Business Transactions

If the Company is involved in a merger, acquisition or asset sale, Your Personal Data may be transferred. We will provide notice before Your Personal Data is transferred and becomes subject to a different Privacy Policy.

Law enforcement

Under certain circumstances, the Company may be required to disclose Your Personal Data if required to do so by law or in response to valid requests by public authorities (e.g. a court or a government agency).

Other legal requirements

The Company may disclose Your Personal Data in the good faith belief that such action is necessary to:

  • Comply with a legal obligation
  • Protect and defend the rights or property of the Company
  • Prevent or investigate possible wrongdoing in connection with the Service
  • Protect the personal safety of Users of the Service or the public
  • Protect against legal liability

Security of Your Personal Data

The security of Your Personal Data is important to Us, but remember that no method of transmission over the Internet, or method of electronic storage is 100% secure. While We strive to use commercially acceptable means to protect Your Personal Data, We cannot guarantee its absolute security.

Photographs and health-related data are transmitted using TLS encryption and stored in private cloud storage with public access permanently blocked. Access to this data inside our organisation is limited to personnel who need it to operate the Service.

Notice for Users in the United States

Biometric information. We do not collect, capture, purchase, receive through trade or otherwise obtain any "biometric identifier" or "biometric information" as those terms are defined under the Illinois Biometric Information Privacy Act, the Texas Capture or Use of Biometric Identifier Act, or similar state laws. Photographs submitted to the Body Analysis feature are used only to estimate body composition and to generate an illustrative image. We do not derive retina or iris scans, fingerprints, voiceprints, or scans of hand or face geometry from them, and we do not use them to identify any individual.

Consumer health data. Where state consumer health data laws apply, including the Washington My Health My Data Act, we treat photographs of Your body and body analysis results as consumer health data. We collect and share such data only with Your consent, we do not sell it, and You may withdraw Your consent and request deletion at any time by contacting [email protected].

No sale or sharing for targeted advertising. We do not sell Your personal information and we do not share it for cross-context behavioural advertising, as those terms are defined under the California Consumer Privacy Act and comparable state laws. We never disclose health-related data, photographs or body analysis results to advertisers or data brokers.

Children's Privacy

Our Service is intended for adults. It does not address anyone under the age of 18 and We do not knowingly collect personal data from anyone under the age of 18.

If You are a parent or guardian and You believe that a person under the age of 18 has provided Us with personal data, please contact Us at [email protected]. If We become aware that We have collected personal data from a person under the age of 18, We will delete it from Our servers without undue delay.

Links to Other Websites

Our Service may contain links to other websites that are not operated by Us. If You click on a third party link, You will be directed to that third party's site. We strongly advise You to review the Privacy Policy of every site You visit.

We have no control over and assume no responsibility for the content, privacy policies or practices of any third party sites or services.

Changes to this Privacy Policy

We may update Our Privacy Policy from time to time. We will notify You of any changes by posting the new Privacy Policy on this page.

We will let You know via email and/or a prominent notice on Our Service, prior to the change becoming effective and update the "Last updated" date at the top of this Privacy Policy.

You are advised to review this Privacy Policy periodically for any changes. Changes to this Privacy Policy are effective when they are posted on this page.
